Robert C. Segear counsels clients in the areas of tax, estate planning, probate, estate and trust administration, and related litigation. He holds a Legal Master’s degree (LL.M.) in Estate Planning from the University of Miami School of Law and is a graduate of the Florida Fellows Institute of the American College of Trust and Estate Counsel (ACTEC).

Mr. Segear represents clients in a wide-variety of legal matters in New Jersey, New York, and Florida. He works closely with clients, wealth advisors, financial planners, and accountants to prepare estate planning documents including wills, revocable and irrevocable trusts, insurance trusts, GRATs, Crummey trusts, dynasty trusts, trust amendments and modifications, decanting instruments, prenuptial agreements, durable powers of attorney, health care directives, and living wills. He also assists clients with funding and administering trusts, administering estates, making family and charitable gifts, and titling assets to avoid probate.

With his extensive experience representing clients in New Jersey, New York, and Florida, Mr. Segear has developed a niche advising clients with respect to residency and domicile planning. He has experience advising multinational clients with pre-immigration and post-immigration tax planning, issues involving U.S. and non-U.S. beneficiaries, structuring foreign investment in U.S. real estate, and developing wealth transfer structures. He prepares revocable and irrevocable dynasty trusts and U.S.-situs wills as part of this planning to address income, estate, gift, and generation-skipping transfer taxes.

Following his graduation from Seton Hall University School of Law, Mr. Segear served as a judicial law clerk to the Honorable William A. Daniel in Union County, New Jersey. He served as an adjunct professor and taught Introduction to Probate and Estate Planning at the Heckerling Graduate Program in Estate Planning at the University of Miami School of Law. In addition, Mr. Segear presented on “Estate Planning for Snowbirds” at the New Jersey Institute for Continuing Education’s (NJICLE’s) Fall 2016 CLEfest and “Estate Administration from Start to Finish” at the National Business Institute.

In 2013 Mr. Segear received a Pro Bono Service Award from Put Something Back, a program through the Dade Legal Aid that matches attorneys with clients in need of legal services in Miami, Florida. He has been recognized on the Super Lawyers “Rising Stars” List, 2016-2019.

Mr. Segear is a member of the Real Property, Probate and Trust Law and Elder Law Sections of the Florida Bar and the Estate Planning Council of New York City.
